GENERAL TERMS AND CONDITIONS FOR CONCERT EVENTS

The producer of the “Great Advent Concert at Rudolf-Harbig-Stadion” is

OPEN-AIR-ADVENTSKONZERT im Stadion UG (limited liability)
Lennéstraße 12, 01069 Dresden

represented by the management

1. Ticket Purchase
Tickets can only be purchased through the local organizer at etix.com event GmbH & Co. KG (www.etix.com), authorized advance ticket sales points, Stadion Dresden Projektgesellschaft, and Weiße Flotte Sachsen GmbH (ELBZAUBER combi-ticket). The General Terms and Conditions of etix.com event GmbH & Co. KG (http://hallo.etix.com/agb-datenschutz-faq/) apply exclusively to the processing of ticket purchases via etix.com and authorized advance ticket sales points.
By purchasing admission tickets or other related services, a contractual relationship is established directly between the contracting party (customer) and the local organizer (hereinafter referred to as the Organizer). The General Terms and Conditions (GTC) of the Organizer, the house rules, and the stadium regulations of the Rudolf-Harbig-Stadion Dresden are an integral part of the contract. The course and content of the events are the sole responsibility of the Organizer. The Organizer is responsible for ensuring that the event takes place.
Through the website, the customer makes a binding offer to enter into a contract by correctly entering and submitting all necessary data for purchase and payment processing and for sending the tickets. The contract becomes effective only after checking ticket availability and confirmation by the Organizer to the customer.

In the event of a concert cancellation, the buyer will be reimbursed the ticket price minus a handling fee of 3.5%. Shipping costs will not be refunded.

2. Organizer’s Liability
The Organizer’s contractual and statutory liability for damages of any kind is excluded. This exclusion does not apply to damages caused by the Organizer intentionally or through gross negligence, in cases of (simple) negligence by the Organizer for damages resulting from injury to life, body, or health, or for the simply negligent breach of essential contractual obligations by the Organizer. Essential contractual obligations are all obligations whose fulfillment is necessary to enable the proper execution of the contract and on whose compliance the visitor regularly relies and may rely.
In cases of simply negligent breach of essential contractual obligations, the Organizer’s liability – with the exception of damages to life, body, or health – is limited to the contract-typical damages foreseeable for the Organizer at the time of concluding the contract or committing the breach of duty. In this respect, the Organizer’s liability for damages that are exclusively attributable to the visitor’s risk area is excluded.
The foregoing exclusions and limitations of liability also apply to the Organizer’s liability for its organs, employees, and vicarious agents, as well as the personal liability of the Organizer’s organs, employees, and vicarious agents.

3. Entry and Exit from the Event Area
Before entering the event area for the first time, tickets will be completely invalidated. Leaving the event venue during the event is not possible. There is no right to re-entry when re-entering the event area.

4. Security Checks
Upon entry to the event area, a security check will be conducted by security personnel for reasons of safety, order, and waste reduction. The Organizer is entitled to refuse entry to the event if the visitor carries prohibited items (see house and stadium rules).

5. Image and Sound Recordings at the Event Area
Only compact cameras and cell phones with camera functions are permitted in the event area. SLR cameras, cameras with zoom lenses, or video function of any kind are not allowed. Video cameras and audio recording devices of all kinds, such as tape recorders, MP3 recorders, and dictaphones, are also prohibited. The Organizer may refuse the visitor entry to the event area if the visitor is unwilling to leave unauthorized devices behind or deposit them for a fee (whereby no claims against the Organizer exist for a possible loss of the device concerned, unless the Organizer can be accused of intent or gross negligence).

6. Exploitation of Sound and Image Recordings
The event will be recorded and broadcast by TV channels. The visitor irrevocably consents to the gratuitous use of their image and voice for photographs, live broadcasts, transmissions, and/or recordings of image and/or sound recordings created by the Organizer, its agents, or other third parties in connection with the event, as well as their subsequent exploitation in all present and future media (such as, in particular, in the form of audio and audio-visual carriers and digital distribution, e.g., via the Internet).

7. Exclusion of Visitors
In the event of an important reason, particularly if a visitor commits criminal offenses (e.g., assault, theft, drug trafficking) or sets off fireworks, or endangers other visitors in the event area, the Organizer is entitled to exclude the visitor from the event. If the Organizer exercises its right of exclusion, the admission ticket loses its validity. There is no right to re-entry or to a refund of the purchase price.

8. Hearing and Health Damage
The Organizer is liable for hearing and other health damages only if intent or negligence can be attributed to them and their vicarious agents, or if a duty of care was culpably not fulfilled. Direct proximity of the visitor to the loudspeakers should be avoided; corresponding barriers must be strictly observed. The use of hearing protection is recommended.

9. Handling of the Admission Ticket
The admission ticket must be kept and is no longer transferable after its invalidation. Commercial resale of tickets is not permitted. Tickets may not be sold at a price higher than the printed ticket price plus proven fees that were charged when the ticket was purchased. Finally, the use of tickets for lottery purposes and/or for conducting sweepstakes is expressly prohibited. A violation of these conditions leads to the uncompensated loss of the right of entry, i.e., the ticket loses its validity in this case, and the Organizer is entitled to confiscate this admission ticket without compensation. In case of loss of the admission ticket, no replacement will be provided.
For reasons of preventing the resale of tickets at inflated prices and the associated damage to the Organizer’s reputation, it is in the Organizer’s interest to restrict the transfer of tickets. The contracting party undertakes to purchase and use the admission tickets exclusively for private use. The contracting party is particularly prohibited from:
a) commercially and/or commercially reselling and/or transferring tickets without the Organizer’s prior express consent,
b) offering tickets for sale in unauthorized internet auctions,
c) selling tickets to third parties for profit,
d) transferring and/or selling tickets for the purpose of own advertising, marketing, or profit generation, or as part of a hospitality or travel package not authorized by the Organizer.
e) The sale of tickets in front of the event venue is strictly prohibited.
f) In case of violation, the customer/seller of the tickets must expect legal action from the Organizer.

10. Visitor Arrival/Parking
The visitor is responsible for their own arrival at the event and parks their vehicle at their own risk. Illegal parking is prohibited and will be prosecuted by authorities; vehicles may only be parked in approved parking areas or lots. The instructions of the security personnel must also be followed in this regard. There is no right to be assigned a specific parking space. Escape and rescue routes must be kept clear of any structures at all times. Free travel with public transport within the VVO network is possible and recommended with the ticket.

11. Weather Conditions
The concert generally takes place in all weather conditions. However, the Organizer reserves the right to interrupt or cancel the event at any time if weather conditions pose a danger to visitors.

12. Notices / Instructions
In addition, the current notices and instructions of the on-site security personnel and the current information on the official website of the organizer www.adventskonzert.de apply.

13. Return of Admission Tickets, Refund of Purchase Price
a) A return of already purchased and shipped admission tickets is only possible in the event of a cancellation or postponement of the event. Ticket orders are not subject to the Distance Selling Act. § 312 b para. 3 no. 6 BGB stipulates that the law does not apply to contracts for the provision of services in the area of leisure activities, which also includes concerts. Thus, a two-week right of withdrawal and return is excluded. Withdrawal from the purchase is only possible until the order has been processed by the Organizer.
b) In the event of event cancellations or program changes for which the Organizer is responsible – meaning changes to the main program part (not “Special Guest” or pre-program) – the overpaid ticket price can be refunded to the customer. This applies only to tickets purchased directly from the Organizer. Processing fees and shipping costs will not be refunded.
c) In the event of a date postponement (event day, not event time) of an event, the admission tickets remain valid, unless further changes are made by the Organizer. If a customer cannot attend the new date, the admission tickets must be submitted to the Organizer within 14 days of the announcement of the date change, as the Organizer guarantees cancellation only within this period. Processing fees and shipping costs will not be refunded.
d) A relocation of an event venue within a city, necessary for organizational reasons, excludes the exchange and return of admission tickets.
e) Changes to admission and start times, program changes, as well as cancellations or concert postponements are possible at short notice. The customer is responsible for informing themselves about any changes in good time before the start of their event.
f) Should the event be wholly or partially impossible due to official orders, safety considerations, force majeure, or other important reasons, tickets purchased for the event will be refunded upon return. Further claims and extended liability of the Organizer are excluded in the aforementioned cases. Processing fees and shipping costs will not be refunded.

14. Payment, Shipping, and Online Shipping
a) For online orders or telephone orders, payment is made in advance. Payment should be made promptly, but no later than 10 business days after the order. Timely receipt of payment in the Organizer’s account is decisive for timely payment. Tickets will be shipped to the delivery address specified in the order. Due to the high volume of orders, shipping may take up to 4 weeks and will be processed in order of payment receipt. For questions about your order, please contact: info(AT)adventskonzert.de, stating your reservation number.
b) For payments via PayPal and other payment systems, the terms and conditions of the system provider apply. Any incurred fees will be additionally charged to the customer.
c) Admission tickets are shipped Monday through Friday, excluding public holidays. If payment for an order is not made on time, the Organizer reserves the right to cancel the order. To ensure timely delivery, order acceptance ends on December 14th. The Organizer assumes no responsibility for the delivery of the order in case of incorrect and/or incomplete address information.
d) If difficulties arise with payment due to circumstances within the contracting party’s sphere (e.g., chargebacks or payment disputes), they shall bear all associated costs and fees.
e) Tickets are shipped at the customer’s request as registered mail or by general postal service to the address on file. If delivery of the tickets is not possible due to the customer’s fault, they shall bear the associated costs. Upon transfer of risk, delivery is considered complete.
f) Admission tickets remain the property of the Organizer until final payment.
